· You acknowledge that participation in padel, pickleball, fitness activities, training sessions, events, and use of Legacy Padel & Pickleball’s facilities involves inherent risks, including but not limited to physical injury, illness, property damage, and personal loss. You voluntarily assume all such risks, whether known or unknown, inherent or incidental.
· To the fullest extent permitted by law, you hereby release, waive, and discharge Legacy Padel & Pickleball, its owners, officers, employees, contractors, and affiliates from any and all claims, liabilities, damages, or causes of action arising out of or related to your participation in activities or use of the facilities, except to the extent caused by Legacy Padel & Pickleball’s gross negligence or willful misconduct.
· This provision is in addition to, and not in lieu of, any separate Activity Waiver and Release you agree to as part of registration, booking, or facility use, which is hereby incorporated by reference.
· These Terms incorporate by reference Legacy’s Privacy Policy, Activity Waiver and Release, facility rules, and any booking or membership terms presented at the time of purchase or reservation.
6. Court Reservations and Third-Party Links
· Court reservations are made through Playtomic or another third-party platform (any such platform, a “Booking Platform”). If you book courts through a Booking Platform, your booking and payment are subject to such Booking Platform’s applicable terms, policies, and platform rules. It is your sole responsibility to review and comply with such Booking Platform’s policies prior to making any reservation. Legacy Padel & Pickleball is not responsible for any such Booking Platform’s operation, user account rules, or payment processing decisions made by the Booking Platform.
· Our website may contain links to third-party websites. We are not responsible for the content, policies, or practices of those websites.
· Certain memberships or services may be offered on a recurring, automatically renewing basis. By enrolling in such a membership, you authorize Legacy Padel & Pickleball to charge the applicable fees on a recurring basis until you cancel in accordance with the cancellation terms provided at the time of purchase. Cancellation instructions and any applicable notice requirements will be disclosed prior to enrollment.
· Minors may only use the facilities with the consent and supervision of a parent or legal guardian, who assumes full responsibility for the minor’s conduct and compliance with these Terms. Members are responsible for the conduct of any guests they bring onto the premises, and all guests are subject to these Terms and Legacy’s facility rules.
7. Code of Conduct
· Legacy Padel & Pickleball reserves the right to suspend or terminate access to the Site, facilities, or memberships for conduct that is unsafe, disruptive, abusive, or violates these Terms or facility rules. We reserve the right to refuse service to any individual as permitted by law.
8. Force Majeure
· Legacy Padel & Pickleball shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to weather events, acts of government, natural disasters, labor disruptions, or facility maintenance or repairs.
9. Photography and Marketing
· You grant Legacy Padel & Pickleball the right to photograph, video record, or otherwise capture your likeness while on the premises and to use such content for promotional and marketing purposes without compensation, unless you notify us in writing of your objection.
10. Disclaimer of Warranties
· The Site, facilities, and services are provided on an “as is” and “as available” basis. Legacy Padel & Pickleball disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

12. Governing Law
· These Terms will be governed by and interpreted under the laws of Texas.
13. Agreement to Arbitrate; Waiver of Class Actions and Representative Proceedings; Waiver of Jury Trial
· Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, your membership, bookings, participation in activities, or use of Legacy Padel & Pickleball’s facilities (collectively, “Disputes”) shall be resolved exclusively by final and binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if eligible. Arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted on an individual basis before a single arbitrator. Judgment on the arbitration award may be entered in any court of competent jurisdiction. The arbitration shall take place in Travis County, Texas, unless the parties agree otherwise.
· YOU AND LEGACY PADEL & PICKLEBALL AGREE THAT EACH PARTY MAY BRING DISPUTES ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION. THE ARBITRATOR SHALL HAVE NO AUTHORITY TO CONSOLIDATE DISPUTES OR AWARD RELIEF TO ANYONE OTHER THAN THE INDIVIDUAL PARTIES TO THE ARBITRATION.
· TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND LEGACY PADEL & PICKLEBALL KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY DISPUTES.
· This Section 13 shall survive termination of your account, membership, or relationship with Legacy Padel & Pickleball.
14. Severability
· If any portion of these Terms is found to be unenforceable, that portion shall be severed, and the remaining provisions shall remain in full force and effect. If the class action waiver in Section 13 is found unenforceable, the agreement to arbitrate shall nonetheless remain enforceable on an individual basis.
